  • Can I get sole custody of my child in Texas?

    In Texas, sole custody, known as sole managing conservatorship in legal contexts, is possible but is not the default outcome. Courts generally prefer arrangements that keep both parents meaningfully involved in a child's life. Sole conservatorship is more likely to be granted when evidence shows that a joint arrangement would not serve the child's best interests, such as in situations involving abuse, neglect, or substance issues.

  • How does adultery affect a divorce in Texas?

    Texas is a no-fault divorce state, meaning you do not need to prove wrongdoing to file. However, adultery can still influence the outcome of a case. A judge may take it into account during property division and potentially award a greater share of marital assets to the wronged spouse, particularly when marital funds were spent in connection with the affair.

  • Do both spouses have to agree to get a divorce in Texas?

    No. In Texas, one spouse can file for divorce without the other's consent. If the other spouse contests the divorce, the case proceeds as a contested matter and may ultimately be decided by a judge if the parties are unable to reach a settlement on their own. If no response is given, the judge may agree to rule in default against the nonrespondent party.
