What A Postnuptial Agreement Can Do

Texas is a community property state. That means most income earned during marriage is community property that can be divided in a divorce. Separate property, such as assets owned before marriage or certain inheritances, is generally treated differently. A postnuptial agreement lets spouses decide, within the boundaries of Texas law, how property and certain financial issues will be handled if the marriage ends or when one spouse dies.
